Divorced and Done

Suing to enforce an agreement on property, plus, my kids are over 18 and my ex disappeared, can I still get child support?

Divorced and Done

Show Notes

This week we received a SpeakPipe voicemail about a listener who has a valid separation agreement for her ex to buy her out of the family home with proceeds of sale from an out of province condo, but the agreement has not been honoured. What's next? Also, a parent who has not seen their ex for 7 years, with kids over 18, has not received child support. Is there still a claim to child support?

Canadian divorce law has operated under a no-fault system since the mid-1980s. This meant that the actions of one spouse during the marriage, including issues such as infidelity or abusive behavior, were not taken into account when dividing assets or determining spousal support. The May 2026 Ahluwalia decision from the Supreme Court of Canada may impact the no-fault system, marking a dramatic turning point for divorce law in Canada.
