This week we tackle 3 questions, first, what to do when your ex wants to push an agreement you just signed, with lawyers, back into Court, and how to prepare for a case conference. Additionally, we talk about valuing real property (the matrimonial home) appropriately to determine a fair settlement, and dealing with parenting issues and decision making, when your ex has basically disappeared and left the scene.

Canadian divorce law has operated under a no-fault system since the mid-1980s. This meant that the actions of one spouse during the marriage, including issues such as infidelity or abusive behavior, were not taken into account when dividing assets or determining spousal support. The May 2026 Ahluwalia decision from the Supreme Court of Canada may impact the no-fault system, marking a dramatic turning point for divorce law in Canada.
