Canadian divorce law has operated under a no-fault system since the mid-1980s. This meant that the actions of one spouse during the marriage, including issues such as infidelity or abusive behavior, were not taken into account when dividing assets or determining spousal support. The May 2026 Ahluwalia decision from the Supreme Court of Canada may impact the no-fault system, marking a dramatic turning point for divorce law in Canada.
This week we're taking some of your questions, including the best jurisdiction to file a claim and time limits for unmarried couples, relocation matters with children, and whether your ex's car allowance should be included in income for the purposes of child support.
