Kohberger Wants His Plea Back After Saying WHAT?!

Bryan Kohberger told Judge Steven Hippler under oath that he was guilty of killing four University of Idaho students. A year later, he filed a petition saying his legal team convinced him to enter a plea he did not freely choose. Which version can a court rely on? Kohberger accuses Anne Taylor and other members of his former defense team of misleading him about conditions on death row and evidence they allegedly did not share. Those claims will need proof. The judge can compare any testimony or records about the plea talks with Kohberger’s own answers in open court, where he acknowledged the murders and accepted the terms of his agreement. If his conviction were undone, the state would still have the evidence Bill Thompson described at the plea hearing. Prosecutors cited DNA on a knife sheath, a Ka-Bar purchase, nighttime cell-tower connections and surveillance of a white car. The defense would have the opportunity to challenge that evidence in a trial, and the state could again seek the death penalty if permitted. Eric Faddis joins Tony Brueski for a legal look at the risks behind the petition. Does claiming ineffective counsel require Kohberger to put some of his attorney conversations under scrutiny? What proof would make that claim more than disagreement after the fact? And how would any court weigh those claims against his admissions? The October 15 hearing was canceled by an October 14 order along with the June 2027 dates. No ruling has granted a new trial. The unresolved dispute is over how Kohberger arrived at that plea. Matthew Farwell's defense is telling a federal jury that Sandra Birchmore took her own life. Eric Faddis joins me to test that claim against the five strongest pieces of the government's case. The DNA comes first. Prosecutors say Farwell's genetic profile was found on the strap used to hang Sandra from a closet door, and that state investigators never collected a sample from him in 2021. The FBI got one in 2024. The phone comes next. Prosecutors say Farwell searched whether Cellebrite could recover deleted iMessages after Sandra died, and that State Police found no messages between them when they looked at his phone. When Timmy Gibson heard JP Miller's sermons, he didn't hear theology. He heard a pastor allegedly using scripture to control the room. Gibson left the evangelical ministry after thirty years and sat down for Homicide Happy Hour to talk about Miller. He quoted one sermon where Miller allegedly told his congregation that if wives fall short, the devil has twenty replacements lined up. Gibson says that's gaslighting dressed as doctrine. Miller has been indicted federally for cyberstalking and making false statements. He denies the charges. Mica Miller died in April 2024. Her death was ruled a suicide, and Miller is not charged in connection with it. Gibson confirmed the word cult with psychotherapist Shavaun Scott before using it on camera. He says the roughly fifteen people still allegedly showing up to hear Miller preach are in one.
