Murder on the Couch

You Can't Un-Ring the Bell: Criminal Defense Attorney Ben Jacob on Lindsay Clancy, Memory and Courtroom Strategy

Murder on the Couch

Show Notes

Lindsay Clancy's jury is deadlocked, and criminal defense attorney Ben Jacob dreads a hung jury more than a guilty verdict.

Content note: this conversation includes discussion of the killing of children, postpartum psychosis, and suicidal ideation.

Tony sat down with Ben Jacob, a criminal defense attorney he's known for years, and they used the Clancy case as a muse rather than a recap. What came out of it is the part of a trial most of us never get to see from the outside, the chess match running between the prosecution and the defense, and what happens to a jury's memory across five weeks of testimony. If you've followed a case online and wondered what the attorneys are actually doing in there, this one fills in a lot of blanks.

In this episode:

Hear why an opening statement works like a promise, and what a jury does when the evidence they were promised never shows up

Follow the calculation behind a mistrial motion, including why asking for one while your trial is going well can hand the other side a rough draft

Track how a memory bends with every retelling, from eyewitness testimony to Ben's own Mandela effect run-in with a wrestler named Hercules

Sit with the mental health thread under this case, including the ideation-versus-plan gate that can leave someone calibrating an answer instead of asking for help

Put Occam's razor up against the conspiracy theories that grow around a high profile trial

Tony is a licensed marriage and family therapist with over 20 years of clinical experience, and Ben has built his career in criminal defense in Northern California, murder trials included.

Ben has agreed to come back, so if something here raises a question, send it in and Tony will pass it along.
